i like 1, i would have shot it a lower position, on the same plane as the guy sitting and i'd blue the background more, so it's color and you can barely see the people.

#2 for the main fact that there's nothing of interest going on in #1. #1 looks like he is yawning. I think the portrait orientation was a good choice for #2 but I would have tried to either eliminate the police officers (re-framing) or incorporate them to where they don't get cropped. But they don't add to the photo in anyway..
