This is from Smugmugs FAQ sheet.

International photographers:
If you can email us with the information that you meet these three criteria, we won't need a USA tax form from you:

1. You are not a citizen of the USA.

2. You do not live in the USA.

3. You do not have a business presence in the USA.

Notifying us of those circumstances clears us to mail your checks. Checks are payable in US dollars.

I meet these criteria, my question is if they send a check to Australia will i have any problems cashing their check in Australia?

You shouldn't have any problems, (As long as your bank doesn't) but a quick email to Smugmug (help@smugmug.com) wouldn't hurt, and I'd verify it with your bank as well since you'll be depositing or cashing foreign currency.

(They may have a certain hold time on it since it will be in USD.)

Smugmug are really good at answering emails, usually within a couple of hours you'll get a good answer back.
