I got a used laptop that had PS6 already installed on it. I want to upgrade to CS but will it ask for a serial# or just look for a valid install? Do I have to get PS7 first? I don,t want to spend the $170 for the upgrade if it won't work.

Techincally you're not entitled to the upgrade because you do not own the license. The license is not the presence of the software but the ownership of the title of use.
Strictly speaking of course.... :?

If I buy the laptop am I not also buying the sofware installed on it. Provided the copy of PS6 is a legal copy is it not just llike buying a used copy of PS? Is it even legal to resell photoshop? Ok if we say I should not be useing this copy of PS6, How far back can I go with older versions and still have the upgrade work. As long as the previous owner did not register the software with adobe I legally own it correct?

You can find a "transfer of ownership" (or something like that) on Adobe's web site. Both of you fill it out, send it to Adobe and you will be the official owner of that particular copy of Photoshop 6. You can use the upgrade copy of PScs with PS6.
Now, the question is do you NEED to go through all that hassle? I'm not sure. If PScs goes through and has you enter the serial and then checks it against their database and finds that the names do not match you will be out of luck. That being said, a system like that would be pretty revolutionary, especially considering users are not required to register their software.
I'm in the same boat as you. I'm trying to decide if I should risk the $170 or just buy the upgrade from Elements 2.0 for $299.

That's not necessarily the case. You need to make sure that you also get a copy of the original install media as well and preferably the documentation. That gives some 'physical proof' of ownership. If it is a preinstalled OEM copy then you should get an OEM license agreement.

B&H has the upgrade for $149.95. CS must be activitated online(or by phone) within 30 days to be used. You do not have to register to use your software. My guess would be that you would have no problem buying, installing, activiting, or registering CS. Let your conscience be your guide.

No you do not own the software just because it is installed. Whether it was registered previously does not matter. The presence of commerical software on a used machine suggests a rather cavalier attitude to copyright on the part of the seller, so I reckon there is a high probability that Photoshop was pirated in the first place.

That's quite a leap! :shock: Adobe has no problem with you transferring one of their licenses. Most people don’t understand copyrights and assume that they can sell their computer with any software they have installed on it. Technically they should have removed windows as well, but that does not mean it was pirated to begin with.
Canreb, Here is the link to the "Transfer of Adobe License" form that I mentioned earlier. You and the person who sold you the laptop need to fill it out and send it to Adobe. Once you do that you will have no problems upgrading to CS.

And this will be the good part... Unless you paid a premium price for the notebook, I'd be surprised to see a Photoshop owner sign over their license as part of the sale of used equipment... I've PS CS from anywhere from $650 and up so and your ownership of license is your "right to upgrade" also... 8)

I think plenty of people understand copyright. The difference between Windows and Photoshop is that it is effectively impossible to buy a PC without Windows, but, of course, the licence and original disks should be included with the PC. Another thing: if the seller still uses their copy of Photoshop, he/she won't want to transfer the licence.

This is only good for US and Canada, so you may have to look again for other countries.
