well i really want to get another battery as a backup for my sd400 but dont want to spend an arm&leg on it. i found a cheap, brand new one on ebay and was wondering if it'll work with my camera. the battery my camera uses is a NB-4L 3.7V 760mAh(Li-ion), what's written on the battery thats up on ebay is NB-4L 3.7V(Li-ion),(dosnt say the capacity). was just wondering since its the same model but possibly a different capacity, will this work safely with my camera?

The voltage and form factor are critical; mAh is a measure of how long it'll last, but won't break anything. So from that standpoint, you should be OK.
