What's Tullamore Dew? a new cordial or liquor?
I stopped drinking and going to bars years ago... and am not familiar with the newest brands of cordials...
(Last alcohol I drank was michelob ultra light)...

Tullamore Dew (http://www.tullamoredew.com/) is Irish whiskey. Quite inexpensive, but still quite drinkable. Nothing special though.
I prefer a Scottish single malt ;) (but that's about four times the price)
tipsy

This seems like an appropriate thread for this photo.
It's been sitting away in my archives forgotton about for ages. Made me smile when i took it.
Trust Imogen Heap, the fluffy, friendly personality who performs bear feet on a white fluffy rug covering the entire stage, to get her stage hand to bring on a cup of good ol' english tea halfway through her set.

Okay so an update on the two girls ... one was very nice to me on the phone and asked to have the photos of her taken off the gallery I set up for people at the club etc. I was like sure no problem. I'm a nice guy... Her friend found me on myspace and sent me a message...
"i see that my friend and my picture is also on youre myspace, you need to take these pics off both your myspace and your webpage before i take legal action"
first off she has really bad grammer for a girl ... I mean, I know, I suck but I'm a guy, I slept in english class. =D
Here is the story... Girls go to the club where there is a live stage show of crazyness every Wednesday night. I meet them early in the night and gave the my card and told them I'll be placing the photos from that night on this website. So Knowing this they end up on stage and pose for me a bunch of times and then start doing crazy stuff... all knowing that photos and video is recording them doing this...
So my question is this. What legal action can the do to me... It's in a place with over 300 people watching them on stage doing crazy stuff... so it's hardly a private matter.
I want to hear what everyone thinks... also there is a twist to this which I'll post in a day.. which makes this even more classic.

A bar is not a public place like a roadway or public building. Unless your use is editorial (you write an article for legitimate media and use the images to illustrate or what they are doing is "newsworthy") they have the right to control their images. Beyond that, if the candid images you publish defame or damage their reputations (regardless of being factually accurate) they might also recover damages having nothing to do with IP. However, for me, none of this is an issue ... I try not to publish images that do not reflect well people, period ... not for any Pollyana reason like being a "nice guy" (which I am not) but because my experience has taught me, "What goes around, comes around." I retain my contract with the casino because they can trust that I would not embarrass them or the performers and guests. And I in no way mean this to reflect on you or your images ... this is not moral advice or judgment ... IANAL ... and the images are entertaining.

"A bar is not a public place like a roadway or public building." I have permision from the club owner to be shooting the show and the on stage action. They were preforming for the crowd to win tickets.
Here's the twist... the girls used fake/friends ID to get into the club they are 18/19 they were found out then booted from the club for life.

Greg, I think that is all the more reason to be circumspect in your postings. It is really not up to you to sit in moral judgment of these girls and it certainly does not give you license to use their images. To the contrary, when you know that you have captured something of potential embarrassment to someone that alone is reason enough to withhold it ... if this was your girlfriend or daughter or sister and you knew it might harm their reputation or cause them embarrassment would you show it around? Again, I don't mean to sound overly judgmental but I do want to suggest a mature and well considered perspective.

The bar owner does not have a say on whether you can *publish* pictures of particular persons (yes, putting them on the web is publishing). I persnoally have no idea whether the U.S. law prohibits it or not, though.
I'd suggest somebody here would write a legal FAQ for photographers (that is based on the law, not perceptions) for U.S. citizens as I every now and then see these questions being raised. Maybe somebody has already done this (try Google).

Sorry for not being particularly mature here, but it's not the photographer who's making the situation look embarrassing...
BUT I personally would have asked for their permission before publishing. The situation is clearly such that there is reason to believe the subjects do not want their image to be published, and I would have no need or desire to publish images in that case (without asking for permission).

I've often admired your work here. I also appreciate and admire your attitude toward photography.
