Hey everyone, i trust you are all well?

for those long term members do you remember last year i was asked to shoot a univeristy Ball? well i have been asked again. now before i send this guy an e-mail back how does this sound to you? i need advise for this aswell.

Thank you. Last year as i was starting out, so I came to an agreement with ***, which was £150 and that was for the disk of photos and a back up disk in case one gets lost or scratched etc, also you can use the Images anywhere for people to buy from you, and for future use, advertising etc. but when advertising, my name/Contact must be on there. How would you feel about that deal for £180? if not we can discuss this?

Hey Bud, yeah it is expensive but they got big acts this year to be fair, last year in the NME is was awarded poshest uni ball lol. be awsome if u went we could meet lol.

What bands are playing? is it the bands that they contract you to photograph? I think the tickets are going for about £40.

Ive done a little editing, see if you like it.

How would you feel about the same deal for £200 taking into consideration advancements in my personal skill and pricing inflation in the photographic market? if not we can discuss this?

P.S- If they ask for a team of photographers- I'm local. heehee

Yea i forgot about that bit. Always state clearly that you hold the copyright to the photos and that you are granting this license to use.

That sounds ace, maybe i will fork out the £40 for a ticket then. Depending on how much my car repairs will cost me on wednesday ( a complete brake refit and shock absorber replacing- Going to have to put off buying any new camera kit for then)

So how did you get this contract then? Do you photo the stages or just walk round photoing the people?

If this is an email communication, I'd keep it short and sweet and to the point...So far so good...let's see what others have to say... There are lots of software packages like, the personal attorney, etc... that offer simple contractual agreements... they ask that all bases of the agreement be covered...

For them to make a decision, you want them to read it... so keep it simple and to the point... you are on the right track... Just make certain you check your grammar and spelling using a word processor program too... (Also, I would include the names of those involved, dates, location, and times of event and your complete address, web site and fax & tel # included...)

I'm leaving for a quick long distance trip in the morning, so I can't help you more at this time... but I'll try to chime in as time permits yet today...

Ha Cars tell me about it, its juts happend to me (Bloody MOT) but off my 5D for another month lol, then just realised i have enough and then oh wait i need to pay for my holiday lol :( i got it last year (obv) and then they got in touch today, what il do is when we have discussed a price and terms etc il try name drop u if possible.

The main stage then the Dance tent is later than the Bands so i go in there after (and between Bands) then walk around a bit, Go to the fair ground etc. Last year was well good, Got to shoot the Fratellis, and the Automatic.

I am very interested to see where this goes and how it is received. I kinda wish I had gotten in on it sooner. I would have recommended using good grammar and capitalization and making it very business like. And 250 pounds would be a fairer price. Please note that photocredit is not compensation but rather a standard practice and requirement for use.

A move in the positive direction is always good... Now that you are more comfortable negotiating reasonable compensation... It gets a little bit easier... They obviously like your work and will do more business with you...

In all fairness, in most negotiations, counter offers should be anticipated... Since they are also businessmen, it's only expected that they asked you for a slightly lower rate...

Just got a call from the casino ... they want me to walk around with somebody for three hours and just take pictures of whatever interesting we come upon ... for the marketing department, a week from today. In addition to over $150/hour they will also provide lunch. When I am done it will be time for me to shoot the boxing event the same evening (in fact, the girl who I will be strolling with is a boxing fan.) It will be a profitable and fun day to help make up for the 'Portraits with Exploding Bowens Generator' that I will finally complete on Monday, sigh. In fact, I think they asked me since they know how much replacing the generator is costing me ... I am always stunned at how well the Chumash treat everyone.

Yes, SHE, I know ... I will see what I can manage this weekend if I get a nostril above the waterline, although I am now thinking that instead of the guest room we may put you in Anna's bottom (wider) bunk ... even if you are bringing a roommate ... as a kind of chaperone ... for you as she doesn't need one, yet! :lol::lol::lol:

Oh She, I bought the 30D with the Fish eye, and i Love it, i think it was a good purchase lol, also went mad and got the grip and 4GB CF Card and 4 card holder, all in same day lol. hhmmmm was a good day!

Congratulations on your new acquisition... A New 30D Camera and awesome lens, 4 Gigs, accessories... Way to do it James...

Regarding your contract... I'll wait till others write something up... I can proof it and possibly modify it accordigly... Need to see one first though... It's been over 12 years since I (retired) wrote any Independent Contractor Agreements, or similar service agreements... I don't even have any on my hard drive any more...

**** - I have sample contracts sloshing around on my hard drive somewhere. Mainly music industry ones but should be able to rework them if you want to.

And if you're interested in getting rid of your old camera - the kid is desperate for one and need it no later than wednesday.

I'm still hanging on to my 350D but it is ever so tempting to jump for a 30D now. My 350 is not even a year old so I will probably hang tight towards fall and see what happens then.
Am hunting for a 24-70 2.8 though.

she, im hanging on to it as back up cam atm, and then i can have both at gigs so not to keep swapping lenses.

Any suggestions or sentences to use i really would appreciate it as i dont know where to start :(

Regarding my 30D, has there ever been a change in the 30D as in like an updated model or something? as when i borrowed my mates, i mean i didnt look through it properly but im sure mine has more stuff on it than his?? i could be wrong and probably am lol.

AFAIK the 30D is the 30D. Only one version....

Short thread hijack: What is all the D30 tosh? I've read about such cameras as a D30 and D20 online, but never, not once, in all my travels to camera stores in the UK have i ever come accross one.

Are they america only?

D30 is a 3mp camera. There was one in LCE in Chelt last year. They go for about £200 body only.

Not to good in all that 'legal mumbo jumbo', but looks good.

'Promotional use' would be what the client would be doing with it, right?
From the looks of it, all rights stay with you, so they have to contact you before they can do anything with the images.
You might want to put something in there specificly, like "The client gets licence to use the images for his website for such and such time. For all other uses, the photographers permission should be asked first". Or something like that, but put in a bit better English ;)

edit: Dunno if that would interfere with / contradict the "complete and sole payment" part.

Well, I was thinking (and it could be English not being my native language): What if they want to use an image for a poster next year, and you'ld want (additional, financial) compensation for that?

hhmmm this is where i go soft, and i say, just pay me for them, one off payment, and then i keep copywrite etc,but they get it for advertising next year or whenever, and because i have only been used last year and now this year, hopefully they will come to me next year? so thats the one off payment section, and that way i can sell them seperatly to the students etc?

Okay, so it's more like: The client can use the images in any way they like, but you retain the same right as well? (So they don't get an 'exclusive' right)

In that case I'd put in a line about them getting a licence to use the images for all useage, except selling them on or so.
But maybe someone more familiair with this stuff can step in?
