evening guys

right have been thinking i have no idea what prevoked this thought but, if a company wanted to use a picture and you sent them a watermarked one for the sake of the argument something like this

to use, and they then removed the watermark without the photographers permission

what would be the photographers postion be ???

random thought i know but im just curious!

They would be totally in the wrong and you should contact them immediately.

The photographer's position would be very strong as you have them over a legal barrel.

The are definitely in the wrong and you should be contacting them or even better have a lawyer who specialises in copyright or intellectual property law contact them ASAP. I'd be going after them for a licence fee for the use of the image to date and wanting to negotiate a licencing agreement for future use.

What are the company in question using the image for? What size company are they?

If they are using the image for commercial purposes not only are they violating your rights as the copyright owner but they are probably using the image without a release from the owner of the car which is another set of problems.

im going to use this image for XXXXXXXX program
just wanted to ok it with you before i did as its the polite thing to do

i sent the chap in question a watermarked image for use on a very well know website (in the right circles) which hits over 100k a day and is great publicity (done it sevral times with bussiness being up after doing so )

anyway this time i get the afore mentioned email not a problem with it being used as ovosly its got my quite clear and distintive watermark on it (not the one above but my new one) and im getting creditation for it in the form of Dominc Romney www.modernpics.co.uk also great. I have nothing to loose because i can never sell the image as i wasnt registered press so cant take pictures for personal or comercial gain.

how ever after talking to other people and also the wording of the email i am expecting him to crop it round the watermark

how ever saything that the event isnt till the end of the month and i could be way over thinking things

From my limited knowlage when the drivers sign up for the meeting the sign a owner release form

They should not be doing that. We went to very light watermarks in strips down the center of photos because of activity just like what you're describing here.
