Not sure what I could have done here to save this one I tried PS on the second one

the only thing you could have done is to overexpose the shot by +2/3 or so but then you would be dealing with a blown out sky. black birds like this RWBB are extremely had to photograph becauase they provide a serious challenge as far as dunamic range.

That's a very difficult shot to get correct exposure on so don't be too hard on yourself. Have you tried using spot metering? Also, when you are shooting birds against the sky you will usually have to increase exposure by a stop or two.

I have a 20D I wish it had spot metering just partial that's what I used

Shoot in RAW, it will save a lot of these types of shots. But, you could open the jpg and use Shadow/highlites on it. Then use the blur tool set at about 8% and make the brush big, swipe over the whole image a couple times to blur the noise, then hit it with some Unsharp Mask at about 50.0, 0.3, 0.0, maybe do it twice if it needs it.
