I've seen a lot of discussions about setting up an LLC and I'm curious to hear if anyone had to attend Judge Judy's court. :-)

I know of two Photographers in my area that have been in the business for 25+ years each, and both of them and myself have never had any incidents. Could it happen? Of course it could... I can't stomach Judge Judy.

I know of a photog that has gotten threatened (to be sued) at least once a year.

There was a thread in the business section about LLC's, but basically unless there is seperation between you and the business you can still be sued. If you run, make all the decisions, make the tea, empty the bins, then you are the business regardless of being registered as a LLC. Any court would do what is known as lifting the veil of incorporation, allowing you to be sued personally. its all down to Insurance.

Having a well worded contract may be more important than incorporating (LLC). Be sure to include contract conditions specifying your limit of liability is limited to the total price charged the couple .. that way at least if they sue the maximum they receive will be whatever they paid.
I have other conditions in my contract as well regarding my performance and it's non - guarantee under certain conditions. I've been incorporated for the past 6 years for my commercial work, but that is more for tax reasons than protection from lawsuits.
