If i take a picture of someone, and sell them that photo without them signing a release for me to sell the photo of them could they still sue me for this?

Yes. You made money from the picture, thus it's commercial, thus it's commercial use without a model release.

That is the one shot where I never bother with a release.

When I shoot (a photo of) a person, and if I know it will have no other value to me except to sell to the person, I don't bother.
