action for watermark, slight problem

dear all, i had couple of attempts to make a PS CS action to batch add watermark and copyright info to my photos, however, i've had following problem.

a. when action applied to new image, copyright logo and photographer name doesn't stay on the same place on the photo, instead, they are placed randomly, is it due my layer lock? i don't think i locked one of the layers when creating the action.

b. second attempt, i locked both layers, however, i couldn't apply action to new images, it gives me error straightaway, saying style1 sheet is not available.

c. when create action, do you need to include "save" command?

you do not necessarily need to include a save command in an action.... although you can and it is useful for some actions....like for my website photos, I have an action that converts from TIFF to JPG, re-sizes and places my watermark, and then SAVES to a specific folder for my websites..

what about the problem i mentioned above? was it due to layer lock?
