I was just looking at http://jalbum.net/samples.jsp (4th one down on the page) and saw something strange (fishy) are they marketing EE on there site with EE's permision? They do give a credit at the bottom of the page, but seems weird to me

All they have done is generated html pages to copy the "look" of ee. There is no database behind it and none of the really nice features of ee.
It is an interesting online album though particularly if all you want is a few generated html pages with the capability for different looks.

JAlbum is great to generate static html albums for CD's, probably the best and easiest application for this kind of albums.

JAlbum gives full credit to EE and is not really intended to be on the same level as EE. I use EE for my main gallery, and JAlbum for small customer presentations.
I think they are both well done and compliment each other nicely.
