Keep the tree, it's an important compositional point of interest that the lines of the road lead your eye to, works well. Nice exposure on the road, but I'd dodge some of the shadow areas a bit to bring out some detail. The vignette on the bottom left I find a little distracting too; crop or clone/dodge out? The sky's nice, it's got that polarizer/soft GND effect.

I think you need to call your representative and get that road re-paved.
