View Full Version : What is considered Fair Use for printing and promotion?

Just to follow up previous thread, I understand printing calendars, even to give as gifts, is off. I kind of expected that, though, even to give as gifts to one's friends seems pretty extreme.

Talking about photos of people and event photos, including sports, music/bands, theater, etc. and sending to contacts in hopes of obtaining engagements/commercial work [as well as to friends and other contacts just as a personal gift, ie. no desire to obtain commercial work].

So what items can one print our to give and our sale?

- A portfolio [loose leaf, binder, actual portfolio]

- A photo book of prints, i.e. meant to act as a portfolio and given away as a portfolio of my work

- A photo book plus text, i.e. commentary/editorial comment on the events, places, people, artists, photos, etc. being given away to show off my work

- "Portfolio" Photobook or "Text/Editorial" Photobook not being giving away but for sale

- Limited edition prints for sale


P.S. actually we are talking about editorial use or non-commerical use more than fair use. Fair use is of anther's photos. I'm talking about publishing/distributing one's own work.

Anyone have experience doing any of the above and whether they fall under fair use without need for releases.

I don't understand what you're talking about. Perhaps you could rephrase and clarify your question. That's probably why no-one's replied to your thread.
