Well the decision is in On Chris Gergerson's case against a defendant for two stolen images. He represented himself and reaped the reward. Way to stick by your Guns Chris!!

Let this be a lesson to those who are having issues with stolen images and copyright infringment situations. Sometimes it pays to do it the right way.

I'm not sure why he didn't go for part of defendant's profits in addition to statutory damages, the award could've been much higher. All in all, good for him.

You have to pick, that's why. Pertinent statutory language:

"...the copyright owner may elect, at any time before final judgment is rendered, to recover, INSTEAD of actual damages and profits, an award of statutory damages..."
