I'm in Ontario, Canada.

Let's say that I take a photo of a person in their vehicle on a public road (and a well known driving road), am I allowed to sell that photo without a model release?

My first thought would have been no, especially since the person may have been identifiable.

But then upon reconsideration I'm thinking that if this is a well known and popular road for driving on (for driving enthusiasts), would it make a difference?

I should clarify, the focus of the shot IS the vehicle. But the person in the shot is what I'm more concerned about.

As art or editorial use, I believe you can in Canada. Anything else I'm pretty sure you need a release if they are identifiable. Someone else probably knows the law there better, so someone else may know better. Also Be careful taking legal advice off a forum.
