Color clipping in HDR?

Im new to this whole HDR scene. Can anyone tell me what causes color clipping in HDR. How to reduce or eliminate it?

What software?
What settings?

Photoshop CS3
8bit color
pretty much default settings

Strange. CS2 does the same. I suspect it's because the light trails are different in each image...
I'd overlay the hdr with a darker version of the last shot, and use only that for the foreground...
