When I crop in CS3 should you check prespective or not.
Seems to be our of prespective when I check.
What is this box for.
I seem to get better results when not checked

I use the crop tool all the time and I've never seen what you're trying to describe, I just had a look and I couldn't find it. How about a screenshot of the control, and of the images it makes?
If it makes the images look bad i'd just not use it.

Do you mean maintain aspect ratio so that you always are cropping 3:2 or 4:5, etc...?

Isn't the perspective tickbox the one you select to enable the corners of the crop box to be dragged
independently of the others, making the crop area non rectangular, and allowing you to fix converging verticals ?

Yep, that's the one.
You only tick it if you want to alter the "perspective". (keystoning)
