Interesting But not something i would be doing to any of my camera equipment. But then i don't have a 40D (yet)

Simply because I can. I wonder what teh side effects would be aside from the warranty issue. They wouldn't have to know. ;)
Until you send it in and they're playing with it and suddenly it starts recording.

It seems to be recording from liveview. If I am correct, this means it is not using the sensor to record... is that right?

It is recording from the sensor but I wonder at what resolution? Is this 1080? And how did he do it?

From his wiki, it seems that Canon had some code left over in the firmware that suggests that they were at least experimenting with a movie mode for the 40D.
It seems that the firmware does have some strings, in the middle of code (!), to suggest LV contrast AF. My bet is that they couldn't get it finished or that they couldn't get the movie mode finished and decided to 'scrap' it all together. The code seems to be there and possibly complete but I don't know how to use it yet.

When I get a 40D I'm talking to this guy. By then maybe he's figured it out perfectly. How come if they were experimenting with it though, why doesn't the 50D have it?

Good point.. The 50D with video makes more sense than the 5D. Maybe Canon was trying to include something into the 5D that made it seem cutting edge and not old parts thrown together. ;):)

I agree, the 50D should have had it as well. So… Does this mean that once again we have a hidden feature in the 50D similar to the 300D? Come on hacker dudes… Time to crack the 50D wide open and turn it into the camera is should have been. And Canon, didn’t you learn on the 300D? Nothing pi$$e$ of Canon users more than putting in a feature and not turning it on. How cheesy!!!

is there a point to record movies on 40D/50D with no sound (other than for amusement purpose)?
of course it's possible to record sound separately and mux it in, but most people don't have the skills for it.

I'd figure that since the video records at about 30 frames per second at ~2MP, then it could be useful capturing specific moments.

Well depending the reason you're shooting, like what some have pointed out for the 5D MKII, weddings. No sounds means easier to just add music to a beautiful ceremony or moment etc.

A member of the dutch site tweakers.net wrote a piece of code to film with the 40D.

From the post on the other forums I think it works as folows
The code is on your CF
then you tell the camera to do an firmware update
The code make the real firmware pumb a view kb to an onther place in the memory
The film code is placed in the created space
E voila; you can film
After resetting the camera the firmware is back to the orignal state.
The guy (DataGhost) doesn't know yet if the firmware is alterd in such a way Canon know's you used the code
