tragic. is it legal for you to be shooting a scene of an accident?

size ok, border looks ok to me (not that it really matters what the border is), and if by watermark you mean your sig on the back of the pickup truck, then it can stay, doesn't bother me at all.

Seems like it was pretty bad.

I can’t see that it would be illegal. We tend not to cover this sort of thing in the UK press but from what I have seen in the US some of the bigger wrecks have news helicopters stacked overhead.

I am not sure I like this picture as all it makes me think is “I hope that everyone is ok”.

I am wondering about your motivation to get the picture in the first place.

And I sincerely hope you were not in a car passing by the accident scene
(that would be even worse than the usual 'gawkers' )

Best regards,
Andy

I'm not sure...I don't think this is art, maybe photo-journalism...are you sure it should be framed, photoenhanced and watermarked ? ? I would have much prefered grainy Black and white, with no frame.

Forty years ago (yes, they had automobiles back then), we were involved in a head-on collision at relatively low speed. It was on a snowy Sunday morning, and we were on our way to church (as was the lady who hit us). There were no serious injuries, and the damage to the vehicles was only moderate. At the time of the accident, I noticed someone snapping pictures, and I remember commenting to my wife that we might end up in the newspaper (They had those in 1965, too).

Later, the insurance companies got into an argument over who was at fault, and photographs showing the position of the vehicles at the time of the collision miraculously surfaced. It turns out the 'photographer' was a local attorney who went to our church, and was a law partner to the attorney who ended up representing us in the lawsuit. In the best tradition of ambulance chasers, he always had a loaded camera in his car. After those photos appeared, the woman's insurance company settled immediately.

In my opinion, it doesnt show any horrific injurys therefore I think its passable as a photo to show people.

As for commenting on it, I cant really, doesnt do much for me apart from to hope everyone recovered as people have already said.

Perfectly legal. Public road, unless the police or fire department closes it off and even then. It's public property. The only thing I would do is not show the victems, I would honor and respect there privacy in a situation like this. And of course stay out of the way and let the emergency people do there thing.

the wreck really wasnt that bad, they had a stretcher out, but it was only front end damage. every ones cabins were still intact. i wouldnt have stopped to take pics of dead people or something really gnarly like that. all this is a picture of some cars, and some people standing there, i certainly wouldnt have posted (or taken) any pics of any one injured.

Based on my 10yrs Fire/ems experience that looks like a very minor accident. Todays cars are designed to crumple. Which make most accidents look worse than they did say 15yrs ago.

Legality: I won't go into the law word for word, but Google H.I.P.A "HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996" burried in this law is sec. 117 which talks about a patients privacy. It effects everything doing with pt confidentiality.
