Hi forum,

My wife have purchased a few items off from eBay for quite a bit of money (Almost $700 USD) The item was sent by the seller to the correct Paypal verfied address and to our knowledge the items were not delivered. We went with ebay/paypal due to the "protection" they offer in some situations. This item was schedule to be delivered last week and up to this point no one in my household has received/signed for the items. Now it happens that the seller when he sent the items with UPS he did not requested Signature Confirmation, which is required for any purchase over $250 USD, UPS claims that the item was delivered. The scheduled delivery day this item was showing "Out for Delivery" in the early morning, "Delivery" at 5:00pm and right above that it showed "UPS Internal Activity Code" and "Exception" on the delivery status. I called UPS and they said the package was re-schedule for delivery on the next day, and nothing happened the next day. After that I contacted them again, and they claim item was delivered the day before and was left outside my apartment, which means the package was left on the sidewalk in front of my door. I opened a claim with paypal and they have resolved this claim to my favor due to the seller not being able to provide a Signature confirmation for this shipment. They have applied a credit to my Credit Card and money should be available the next few days.

Should I be concerned about any actions from the seller? I know he cannot do a chargeback since he is the seller. But I am concerned if he can take any other actions. I mean this person has my name, address, phone, email address. Paypal has told me that he could file an appeal, but most likely it will not be granted since he openly stated that he did not required any signature confirmation.

Should I be worried or should I keep freaking out like I am right now? Should I use this money to buy the items it was intended for? Will there be any threats. I know if this person did not asked for Signature confirmation it was his responsability and the outcome is part of his neglection, but at the same time I understand he might be loosing money too.

I guess I am looking for some good advice in this, since I am overly concerned with this situation.

Any comments will be greatly appreciated.
Thanks,
Ariel

The same thing happened to me late last year: a high priced item and no signature confirmation. The seller can't do anything to you, and if he tries, call the police immediately.

Will he be able to file and win an appeal with paypal? Even when he admitted that he did not request a Signature Confirmation for this? My concern is that even I got refunded he will somehow get money again from me. He violated the User Protection Agreement with paypal so I guess there is now way for him to do it. But we all know how paypal works sometimes, that's what i fear right now.

Thanks,
Ariel

Relax, Ariel. The seller is stuck, and if he wants to proceed further his next step is to file a claim with UPS. Which would be the smart thing to do, but I gather that UPS will give up a dime only when you can pry it out of its cold, dead hand.

Uhhh, why call the police? Unless the seller threatens unlawful activity (like sending you to sleep with the fishes) it's a civil issue and the police have no interest whatever.

So, I should be okay if I go ahead and spend my money that has been credited, or should I wait to see if he files an appeal?
