Any of you that know the Howard Stern show know that people offer free services and products to the staff on the show all the time. I'm a huge fan and some of the comedians from the show are coming to do a show in my area. I offered to shoot the show and my offer was excepted. After squaring everything away with the production manager I get an email from the president of a company called efotolab.com, basically an image hosting site that is starting a partnership with Sal and Richard from the Howard Stern Show to host all the images taken by their photographers for the fans to buy.
The gig that I'm shooting will be the first in this new agreement. Efotolab want s me to sign over all the images from the show for them to sell, as payment all the images will have my name and website and I will get a banner add for 1 to 2 weeks starting when the pictures are posted.
Anyone who knows the Stern show knows that if a website is mentioned on the show or in the plugs gets tens of thousands of hits almost instantly and for days following(because of replays)
I haven't seen the contract yet but providing I still retain the rights to use my images for my own portfolio, what do you think of the offer?
I was going to give Sal and Richard the photos anyway but not with rights to sell.

I think the offer bites. But what have you lost? Nothing. What do you want out of it?

Personally, I'd ask for a % of sales. sign over all the images from the show for them to sell, I'd reserve the right to only deliver the best images. tens of thousands of hits almost instantly Best to have all your ducks in a row to be sure that you can take advantage of it re: customer service & answering emails quickly. And can your server account handle the traffic?

I got the contract late last night and I declined their offer. My deal with the comedians was to come and shoot like a photojournalist, candids and so on.
I was going to give them copies of the really good shots for them to use on their subsequent websites. I would retain the copyrights just in case my images would ever get looked at for any type of publicity or advertising for anything other then their websites.

This is what the contract with this Efotolab stated.
-Show up 1 hour early and scout the place out
-Stay till everyone has dispersed
-Keep track of every image taken of a fan with the comedians and hand out cards to everyone who had their picture taken
-Every shot must be vertical

There is a lot more that made this a crappy deal but there was the part of every sub contractor agreement that I refuse to agree to.

-Don't talk about or promote any other business but Efoto lab including my business.
This is my home town, there are probably going to be a bunch of people their that I know and what if I want to hand out my card so that people might look at me for weddings or what ever.

I do some top secret stuff for a very large government contractor but it's still private.

Hell yeah you made the right decision anyone that would take a contract like that doesn't ever deserve to have any success in photography.

Definately seems like a bum deal. I gotta ask though, what would be your percentage of the cut from the profits?

I spoke to Richard Christy today from the Howard Stern show. He has never heard of this guy or this website. The guy from the website even told me they are offering the pictures of the fans and the comedians autographed! Now how do they expect to do that if the talent has never even heard of the guy.

Alleh-
I don't think its right to say that someone doesn't deserve success because they make a bad decision.

Shows as popular as HS primarily rely on 'free' services derived from the exposure the service will get from them. From what you have posted, you wouldn't have gained the type of exposure that would result in a desirable result. Good on you for not being blinded.

I spoke to Richard Christy today from the Howard Stern show. He has never heard of this guy or this website. Then, if they don't have a contract with HS, maybe you can go with your original plan to shoot? the president of a company called efotolab.com, Guess what? I are a preSidant, too! :D

- You GIVE them all your images along with the rights to them for FREE and they are going to sell them?
- In return you get photo credits and a banner ad (both of which still cost them nothing)?

Please read those two statements over a few dozen times until it starts to sink in how badly you're getting screwed.

You obviously didn't read the whole post.
I knew from the start that their plan was to sell them. That is why I said no.

The question was would it be worth it to get the credits and ad space?
I know now that it is not.

PhotosGuy- I am still going to shoot as planned, my agreement was with the comedians and they are still excited about having me.
