You haven't put a location in your profile. The best thing to do is ask a local lawyer or accountant.

It's the same all over, generally, yes you need a business license in order to start doing photography as your primary source of income and charging. Just go to your local city or town hall and apply for one. It's wise, once you get started up (after the first 6-8 months) to hire a bookeeper and contact a lawyer before setting up your business. Though generally it's not required and not needed. Pretty common sense. No big deal.

It depends on State, County and even town regulations. Not all States, Counties and towns require a Business license. Easiest way is to check with your local town hall or city hall.

I agree. In some states it depends if you're setting up an LLC, Sole Proprietorship or some other type and the costs can vary.

Disclaimer: I am not a lawyer seek one for more accurate information...
Being in Virginia myself,
Check on zoning ordinances for studios as well as licensing for photographers. A lot of cities in Virginia have specific zoning for photo studios if permanent structures (AKA the Garage). I cheat sort of by having a portable studio setup which is down more the up, meaning my living room is my living room more often then it is a photo studio.
But you will almost certainly need a business license and if smart do the paperwork for a LLC or equivilant incorporation to minimize liability.
The one exception is if you are working on commision for another company with a business license, in which case their's covers it usually.
Definately do searches against the legal databases, if you are not going to actually pay a lawyer to research for you (or better do both)
