There is now an official statement from the Transportation Security Administration that clearly states photography of TSA airport security checkpoints is not a crime.

I took pictures in Honalulu airport. If anyone has been there, you know that they have no glass separating the tarmac and the general area. So I took out my XS and starting shooting pictures of the plane we're about to board. As I put my camera away, the pilot in the plane opened his window and waved at me..damn I wish i got a shot of that..so we waved back.
