At what point is it required to obtain a property release? If I was shooting pix of a garden or beautiful landscaping located on private property (private home) do I need a release for commercial use? Assuming I shoot from a public sidewalk or street, of course. What if the house is shown in the photo?

How about street scenes which encompass a large portion of street or cityscape?

Are there any books or websites that spell this stuff out?

I may be way off here, but I would say if you're shooting photos of private property and plan to sell the photos commercially, you need to obtain a property release regardless of whether or not you stand on public property to take those photographs. If you photograph a celebrity and sell it, the fact that you took it from a public sidewalk would not be a defense in court... Same would hold for property.

Bruce I am going to have to agree with you on this. As a general rule, if your selling the image for anything other than editorial purposes, you need a release for humans, pets or property.

Wait a minute, Paparazzi don't get releases. If someone is in public there is no right to privacy is what I thought. I know with "some buildings" you need a release. But with people in public, especially celebs?? I find that hard to believe these celebs hate the Paparazzi and would never sign anything for them to publish their pics.

Let's say that I shoot a photo of one privately-owned building, and I want to sell that photo for a publication. I would probably want to have a property release.

Now, suppose that I swing around a little and get more of a scene of a whole city block, and there are five different privately-owned buildings in the shot. Do you think that I am going to get a property release on each of of the five? If you answer "yes", then continue.

Suppose that I swing around a little more and get more of a scene of several city blocks, and there are 25 differently privately-owned buildings making up more of a skyline shot. Do you think that I am going to get a property release on each of the 25?

My point is that there are no hard rules here.
