This has been discussed in other threads. Answer = probably. Consensus is that it is expected to be discontinued once retailers sell remaining stock. It will probably be 'officially' discontinued in the next few months, maybe sooner.

Once a higher number like the 50D or the soon to be released 60D comes out the lower number body like the 40D is discontinued, but there will be some stock left on some store shelves that needs to be cleared. Once this stock is gone then the only way to get that model is in the used market.
This should not come as a surprise. With the 12 month replacement cycle there will almost be new 40D's still to be had when the 60D is released. This will be helped by the slow economy too.

The 40D probably hasn't been produced in a year, when Canon started making the 50D. So yes the 40D has been discontinued for over a year. When the 50D came out the 40D immediately is discontinued. They leave the old model on their website for people to look at so resellers can sell their remaining stock and Canon's remaining stock but it isn't produced anymore.
