So I am in the middle of trying to figure things out with Getty and I also just had Runner's World request all of my running photos to keep on file for stock. Know I know you don't need a model release for editorial but I have had magazines request a release does anyone know if photos ran in a magazine like Runner's World would be considered editorial?

I have had magazines request a release For these shots? I'd guess it was for some other purpose as I'd consider these editorial. Now, if they wanted to sell stock for advertising, that's another use altogether.

Yeah I told them they didn't need it but they are newer to the game and only on their 6th issue and maybe don't really understand copyright laws. I just wanted to double check.

If use for an editorial article, they don't need a release.

What's the specific usage ? I'm all over this stock and licensing stuff...having just filled 10 stock requests, today. (though more than half of that was for previous shoots I had done and the other couple were from random advertising companies on the web)

Got caught up for the rest of the month, woo...I've been having a lot of questions, too, and uncertainty about the scope of copyright, licenses and how to thoroughly illustrate everything properly.

So using an image to show a specific yoga move and such would still be considered editorial correct?

It depends on what the image is doing, if it is used as an advertisement, then it is not editorial. Your agency will probably accept released and non released images and sell as such for the uses. The Runners World should be fine in running images as an/or with an editorial, as long as they are not using it to sell something, which would then be classed as advertising. So the Yoga move, to sell something and showing face, then you need a release, if it is with a story about yoga, then editorial, although I would have a release for an image like that so I could expand it's uses.
