View Full Version : Guidelines for photo pricing....?

I'm curious what the guidelines for photo pricing would be for a photo published in an online (only) newspaper (as a large photo).

I'm not sure what the distribution is yet, but are there any resources I can go to to find this? Or do you guys know the typical charge for this sort of thing?

Also, are photographers entitled to any extra money for copyright infringement, outside of the base rate price?

Generally you accept what the newspaper offers or you go elsewhere. If they use an image outside of the licensed terms they're violated copyright and you can sue them, or just send them an invoice for whatever you like - they probably won't pay it as they know you're unlikely to sue them.

Not copyright, just usage rights.

Copyright infringement would be if they were reproducing, selling or reprinting and selling your images or claiming them to belong to them.
Usage rights would be outside the terms outlined in your licensing agreement, so you can bill them based on the amount they go over ...sort of the same way that internet providers do with bandwith or cell phone providers do with minutes or extra charges

You can sue them for violating your copyright, but with your usage rights it would be a good idea to just terminate the agreement and send them an invoice detailing the extra amount they used and what the price was, refer back to your licensing agreement.

Where I'm from that's how it works. It's a quick trip to small claims court to get them to cough up if they don't, too, and you've got virtually all you need to make them do it. Though, your relationship with them will be out the window, most likely, so that's always something to consider.

They are also entitled to extra money (sort of) if they win the lawsuit for copyright infringement

Oh one more thing...along with your licensing agreement make sure to include a contract along with it. I like to keep them separate but with some people, I've learned, it can just be a select clause that states about the work done, the payment received under the circumstance, etc.

Newspapers are next to broke, though, and a lot of them do have people that work for the newspaper and handle the photos, or they go to Getty.

No, there's no agreement here. A online only newspaper stole one of my images from flickr. They attributed me and claimed "creative commons", however they got that part wrong. It was actually copywritten at the time. They never contacted me and never asked permission. I want to know how much I can charge them for, something that's at least moderately sane. I'm a poor college student, normally I'd let them use it for a nominal fee- but If they just want to steal my images I'm ready to push some sort of action.
