I know, I know, I could probably type in release blah blah...I've been there and couldn't find anything directly relating to my question. If you don't know, please don't respond, If you do know I would appreciate the benefit of your knowledge/experience.

I took some gig pictures a while back of a band, with their permission and the permission of the promotion company.( nothing in writing) I burned copies off for both parties and they were very happy, no money involved.

Now, some time later, an unrelated person would like to buy some of these pictures from me. I have lost contact with the band. Do you think I can legally sell these phots.

I should point out that I was not commisioned by anyone, just asked their permission to shoot.

Thanks

You probably should ask Rumpole that question. If they're for his personal use, my guess is that I'd sell them.

What does this other person want to do with the photos? If he wants to hang them on his wall at home, your proabably ok, not leagally ok but I doubt taht anyone would find out and try and bring a lawsuit against you.
Now if he has a commercial use in mind, absolutely not. That can get your butt in a sling in a hurry.
In the future get a signed release

The guy owns a music style coffee shop in an urban trendy part of town and wants to hang them in the shop, with a view to selling them, to anyone thats interested.
So I guess I'll have to try and track down those involved and get them signed off.

Or, ask HIM to sign a release stating that the pic was bought without permission to publish? Again, ask your local Rumpole!
