pretty good picture, but i'd try to bring it out some more by using a little fill flash in PS

I agree. Nice catch, but too dark.

how would you prefer to lighten an image in PS withour loosing the contrast?

I'd use a Levels or Curves Adjustment Layer since it doesn't make a permanent change to the image. NEVER use Image> Brightness/Contrast 'cause you can never go back to the original file quality.
BUT, I no longer make those changes in PS. I shoot RAW & make the changes in RawShooter. WHy? Look at:

As the other's have said its a shame the first two images are so dark - Frank has give some good advice but if you are using Adobe PhotoShop there's an action that I think you can still download called "Modified Contrast" it works on a new layer and allows you to control how much lighter you want the dark areas. If you can't find it I can send it to you as a private e-mail.

I hope you don't mind but I've taken the liberty of using the action on the shots you posted.

I think the modified second picture is much better than the original.
The second image, however, still lacks to much detail in the bike and rider.
After all, aren't the bike and rider the main subject of the image.
For me, I think the second image could easily be the better of the two photographs, given a little more manipulation.
I think I'd concentrate on gaining some extra detail in the bike and rider.
I'll be very interested to see what you can do with it.
