Can someone post images of myself/family on their website without my permission???? i.e. someone hijacked pics of myself from facebook and posted them on their website. Is this legal????

the pics belong to me. Belong as in pics you took or pics they took or pics someone else took? ? What are the terms of use for the sites? What was the purpose for posting them? "How not to take a shot"? "Look at the dufus"? "This guy really likes my product"?

the pictures are personal pictures of me and my family posted to only share with firends and family...

If you ONLY want friends and family to see them, don't post them on FB.
Email them directly to your F&F. I don't think FB has any kinds of privacy settings on photo albums...
Look into some of the other hosting sites (flickr, photobucket) and review how they handle 'private' galleries (passworded or only a certain list of people can see)...
That is the only way to keep others from poachin' your online photos. And even then, who knows what your friends & family may do with them once they have access to them... perhaps they'll put one on their blog... bam, it's available to the world again...
You should simply ask the person using your photos without your permission to remove them. If they are posting them on their FB, or their website, you can probably contact the hosting company and point out the violation ('tis basically a copyright violation - use without permission)...
Don't post photos in a public forum that you don't want out there for anyone to snag and do with what they want... you WON'T stop them... sucks, but it's true...

Well, at least you didn't think... ;) It's quite the contrary. Facebook has really awesome privacy settings. It's just up to you to customize them.

Yes and no. They also hold the right to use your photos for anything they want, so they can plaster your face on "find hot guys in your area" ads (or sometimes they screw up and do "find sexy ladies in your area"). It has happened, you should look it up, the cases where sometimes quite hilarious.
I second not putting them onto facebook. If you have a website, make a hidden directory/gallery for sharing with friends (or get a cheap smugmug regular or similar account, this is actually suggested if you have only a business website). Facebook changes their policies and your settings far too often to consider them a legitimate service.

Actually what is says is...
You can use your privacy (http://www.facebook.com/privacy/) settings to limit how your name and profile picture may be associated with commercial or sponsored content. You give us permission to use your name and profile picture in connection with that content, subject to the limits you place.So you can click on Privacy -> News Feed and Wall and click on the Facebook Ads page. Then you can change "Allow ads on platform pages to show my information to" No one.
Though I do agree. They seem to add things every few months that require a new privacy setting to be set. Often times it seems the default is to have to Opt-Out instead of having to Opt-in to it. But last month alone, Facebook drove traffic to my EM site which resulted in $1,400 in sales that probably would not have seen the site. (The people ordering were friends of friends.)

The person who took the pictures has copyright. They have the option to pursue action related to the copyright.

How are they being used? What kind of website?
I don't think you specifically answered the question as to whether or not you actually took the photos. Did you actually take the photos (trip the shutter)?

Here's the deal....my wife took the photographs (of me and my kids). The photos were actually posted in a networking/social forum (not Facebook or Myspace, by the way, just used FB as an example). This person obtained the photos and has them posted on their website along with a forged document containing my sig. This person is bashing me on their website, using pics of me and my kids alongside a forged document that was altered.

I agree. This goes beyond a simple copyright infringement and straight into forgery, fraud, libel and defaming.
Be sure to get a screenshot and some other evidence of what is posted on their website. Some witnesses may help as well, before it gets taken down from the website.

Since I din't think, I took the time to check out the photo privacy settings (I knew there were basic privacy settings on profiles and such)... and I sit here corrected. There are indeed specific album settings. You can make one only viewable by friends, and the next for everyone...
But alas, it's a moo* point anyway as the OP wasn't really using FB... and I kinda wonder what the WHOLE story is, but not enough to really want to read about it...
Call a lawyer is indeed the best advice here LittleRock.
