how much leeway is there to photoshop out the dude in the back

Is it to be used as more of a promotional shot or a shot that is documenting a particular event?
Promotional shots are more "editorial" content (imho), and I would have no problem doing any amount of photoshop to something like that. If you're documenting and event, I think it's best to keep photoshop to a minimum.

I'd probably crop it first (since it needs that anyway), and then burn the photographer.
I tend not to clone unless it's for advertising (and dust spots)
Also, converted the image to a link, since it was quite a bit over 1024 pixels ;)
