Copyright issues vary from country to country. It might help to state which country you want the info on.

Depends on the usage of the photo that you're selling and also depends on the context of the photo.

You need more specific examples to get any real answers.

The answer to every one of your questions could be yes or no.

Most of the things you have listed are public domain but could be private property. If someone is in a public domain, you technically have the right to take a picture to sell it however I'm not sure whether it is legal to sell a picture of children without legal consent.

but what do i know. i'm not a lawyer!

click on that link. read and scroll down to the interview (part 1 & 2) with Ed Greenberg (an IP attorney with quite a lot of experience).

That will HELP answer some and even possibly a lot of your questions. IMO short of hiring your own IP attorney, you probably won't get better advice from someone with more experience than this guy.

If you are selling the photo itself as a work of art and not using it to promote a product or service, no, it is not illegal. If you mass produce the image--as a poster or tee shirt--there are cases where that kind of use has run into problems.

if i take a photo of a person wearing a brand shirt with logo and sell that is that illegal ?

If you are selling the photo of a person wearing a logo tee-shirt itself as a work of art and not using it to promote a product or service, no, it is not illegal. If you crop away the context of the man wearing the tee-shirt so that you're only showing the tee-shirt art itself (so that it's no longer clear that it's a "photograph of a man wearing a tee-shirt"), then you will run into problems.

if i take a photo of a billboard and sell it is that illegal ?

If you are selling the photo of a billboard itself as a work of art and not using it to promote a product or service, no, it is not illegal. If you crop away the context of the billboard so that you're only showing the billboard art itself (so that it's no longer clear that it's a "photograph of a billboard"), then you will run into problems.

if i take a photo of some 1's painting or a photo of a photo and sell that is that illegal ?

If you are selling the photo of a painting on a wall itself as a work of art and not using it to promote a product or service, no, it is not illegal. If you crop away the context of the gallery wall so that you're only showing the painting itself (so that it's no longer clear that it's a "photograph of a painting on a wall"), then you will run into problems.

Ummm, y'know the search daemon is pretty literal. You might get more hits if you try spelling it without the "w"...

What? Are you implying that spelling counts on the web? What's next? Proper capitalization? Or maybe punctuation?

Hell, next you'll be espousing good grammar overall!

Depends on who you ask - there is that Union Jack still on their State Flag... ;)

Not at all. Looking stuff up, however, might be a different issue.

Exactly! On their state flag.

Exactly! On their state flag.

Not all Hawaiians (ethnic) or Hawaii residents want to a US state, but I'd bet big money that none of them want to be part of the British commonwealth.
