what to choose.... the canon is in good condition... about 25% more expensive than the Tamron ( new one )

If the Canon 28-70 is a good one, then go for it :D
It will certainly hold its value better than the Tamron, and it is a great lens. The price sounds very hot, if it's a good copy.
I did a similar comparison (http://photography-on-the.net/forum/showthread.php?t=50584), but with the older 28-80/2.8-4.0 L.
I went with the suggestions and got the Tamron 28-75/2.8 instead.
I am very happy with the lens, but the 28-70/2.8 would have been a totally different thing.
Best regards,
Andy

Agreed if the 28-70 is in a good condition, go for it.
Same comment as Andy, I went with the Tamron 28-75, great lens but not in the same category as the Canon 28-70.
That being said, you get a six years warranty wth a new Tamron 28-75, not an easy choice.

You already have a couple of Canon lenses and a great camera too. If the 28-70L is a good copy I can't see one wanting any 3rd party lens for near the same cost. Keep in mind that the Tamron's focusing and zooming rings rotate in the opposite direction of the Canon's and you are already used to Canon's rotation.

is it true that the canon 28-70 is not weatherproof and dust proof, thought alle L lenses was!

You know the answer. You don't want to look back later. (at least I hate when I do)

Generally, people who buy the L don't generally sell their lens and then once they have it, they usually don't need to look for anything to satisfy them. So if the used is in good condition, go for it. The new Tamron would have to be a better price with a like 3 year warranty for me to consider buying that over the Canon.

New tamrons have a 6 year warranty, don't they?

the tamron is a much lighter lens. i just got a tamron 28-75 to complete my set of the tamron twins and i love it...and it's a real joy to shoot with.
that said, if the canon is a good copy and in decent shape i'd get it. you could always flip it for a profit it if it does not meet your expectations.

Overall I prefer the Tamron. It is a much more compact lens, whereas optical quality is very close to the Canon. I don't believe that the remark regarding the resale value of the Canon vs. the Tamron is relevant. The Tamron lens can be found for very little money when new. You could lose the full value of the lens and not lose much.
Both are very good lenses.
BTW: I use the Canon lens and the Tamron is mounted on my wife's 350XT.

You made the right choice.
Don't worry about the small scratch, you will soon end up bashing the hood, as they are so big, I have on both my L's
