View Full Version : Can I Sell Concert Photos Shot at a Public Park?

I am in Canada and I have never looked into selling my concert photography before. I am curious about my rights as far as selling photos that I took of the band(s) during performances.

Do I have the right to sell prints (e.g. through Zenfolio or Flickr) that I shot from the front row (or anywhere else for that matter)? There were no tickets or any documentation handed out at this particular venue. all we did was pay a small am ount for entry into the park and got a stamp on the back of our hand.

I recently consulted with a patent and copyright attorney about this same topic. His reply was. "it depends on how the pics were obtained." He told me that if I was granted photo access by the venue/PR people/Artist Management, etc, the photos were considered to be obtained legally and that I, ALONE, owned the copyrights, therefore, being able to do what I please with MY photos. If I was a random audience member, with no official photo authorization, the photos would be considered to be obtained without official authorization leaving the copyrights with the artists. The moral of the story is, if you were given official media access, the pics are yours to sell as freely as you feel like sitting at the park or flea market. Hope this helps!

I suppose it depends!!!!!.
If its a public park you have every right to sell the photos,If its at an arena then maybe not.I think you said puplic park in which case you could have stood on the sidewalk pavement whatever people like to call it and taken the shots,go on sell them.
