Re: Has the privacy line been crossed?

He'd wind up in court in Texas. He'd likely win, but they would jerk him around anyway.

Re: When do I need a Release?

Head-to-head advertisements are pretty old.

"Dissing" the opposition is not the same thing as trading on his mark, at least as far as the courts have been concerned.

Re: Covering your eyepiece / viewfinder

If you do a lot of very long exposures in bright sunlight--the circumstance in which eyepiece light leakage would be an issue--it's a good idea to carry a towel (preferrably white or otherwise...

Re: i read the "when do i need a release" post, but what about landscape type work?

Architectural designs are copyrighted automatically, just as photographs are, but in the US photographers have a "pass" written into the law that allows them to be used in photographs without it...

Re: Covering your eyepiece / viewfinder

Obviously it depends on how much light is entering the eyepiece, not just the length of the exposure. I've seen the same thing "proven" by people putting electronic flash units against the eyepiece...

Re: Has the privacy line been crossed?

Yes.

If it takes special equipment or extra-ordinary effort to see it, then, yes, the reasonable expectation of privacy has been invaded.

What if someone had built a privacy fence and we caught a...

Re: Has the privacy line been crossed?

Or, for that matter, maybe I want to argue with his "artistic syntax" and point out why what he meant is not what he actually said. At least even then, there is a point to giving mental energy to...

Re: When do I need a Release?

That comes into the realm of trademark laws (and sometimes copyright laws), not model releases (the sign does not have "privacy rights").

In most nations, a trademark has to be registered with the...

Re: Has the privacy line been crossed?

Andre Serrano's work has never impressed me, but his work is "art" and he is an "artist" to the extent that he intends to make a point and he makes it with consistent success.

I'm less impressed by...

Re: Has the privacy line been crossed?

Good street photographer, however, is not just pointing a camera at strangers--it's not as if one set a camera up on a street corner to take a shot automatically at intervals.

Good street...

Re: Has the privacy line been crossed?

I seem to recall something like that actually being done some time ago as "performance art."

And it's been done by many people on the Internet using their webcams.

Re: exclusive or non-exclusive license

And the usage sold to a client--whether exclusive or non-exclusive--might be limited by time or area, in which case you can still sell it outside those limitations.

A client might, for instance,...

Re: Maybe a bit ironic with all of the talk about the photography business dying....

If it's an up-and-coming professional, maybe an ad targeted towards the specific desires of such people is what's needed. Not just ducats per hour but also permission to use the images in their own...

Re: Has the privacy line been crossed?

Read the law--there is no proviso "unless the occupants are nude." In fact, the Texas law has even further provisions that make it a greater offense if the persons seen happen to be nude. At that...

Re: Has the privacy line been crossed?

The Texas law is very similar to the PA law that I quoted. It would be illegal to be peeping through other people's windows, and if you photographed such activities, the photographs themselves would...

Re: Has the privacy line been crossed?

Privacy matters in the US are state court issues, but state courts have ruled that, for instance, persons in a booth in a restaurant have an expectation of privacy, even though the restaurant is...

Re: breaking the rules

Notice, please, that I said "I." I'm not really concerned about the chances other photographers take with their subjects. Some photographers get their subjects drowned, too.

Re: breaking the rules

If I "know it's prohibited," (or even if I suspect it) I would never take a client there. I'm not going to run the risk of getting a client arrested, hassled, or harmed doing something I knew was...

Re: breaking the rules

Probably not. The feds always build fences and post signs if their intention is to keep people out. If you were driving through it, I presume there were no such signs.

Federal laws rarely prohibit...

The purpose of insurance is to protect against catastrophes--career extinction events. ...

Re: Insurance coverage requirements?

Seems excessive to me. I've had to indemnify venue owners but never every employee of the venue, for instance, and certainly not "and their actions."

Speak to your agent about what really ought to...

You didn't really say what kind of photography you're talking about.
