IMO any painting cannot be a direct copy of anything including a photographic image simply due to a human being is holding the paintbrush. It might be a close resemblance but that is as close as a painting can get to any image. Two painters doing the same interpretation of even a tree or the letter Q are not going to be identical paintings. That is how fakes of famous paintings are exposed, no two painters brushstrokes are exactly the same.

I've had people ask me for copies of my photographs that they want to paint, I have no problem giving them to them.

So if I take a photo of something and then someone paints a photo of the same scene it is plagiarism? Cool.

If two people take a picture of the same car and a third person paints it, they are all going to jail for a very long time. Be careful, don't let this happen to you.

I had someone who had one of my prints ask if she could "paint" a copy and I was "sure, why not?" -- I never heard any more about it, but say, if it ended up in a gallery, well, cool! Maybe if she were to sell it I'd hear something, maybe see something in my PayPal account...!
