If you do have a contract and a clause in the contract stipulates that B has no rights to image usage until satisfactory payment is received by B, does A then have the right to take downs without a court order? YES YES YES YES..........

You can also put in that if you have to start collection proceedings that B will pay all of A's COSTS which is good to have in there..........

I'll bet your teachers liked you............

There's a stamp on it labeled as "Attempted Not Known" on it. I found out he moved offices conveniently when I sent this letter, I may try sending it one more time to his new address.

Keep resending. When it comes time to go to court, keep all documents. Most courts tend to frown on people changing addresses or disappearing. Could be that the guy has bigger financial troubles.....

He does not need to sign for receipt. The fact that he refuses delivery speaks volumes. Also send another one regular mail, and get a receipt for the 34 cent stamp at the same time you send the certified/return receipt. You can prove to the court that you made an honest effort to adhere to the law in an attempt to collect a debt by sending 2 letters.

The fun part will be when the court sends documents if it goes to small claim and they are refused.

I definitely will resend them again, but the whole court thing sucks because I no longer live in Vegas, so I would have to spend additional money to appear in court, and I may still never see the $ from him afterwards, AND be out the cost of the trip to Vegas (I don't really need to go back other than to see friends lol)

Unfortunately business is about making money and sometimes it just isn't worthwhile to pursue a bad debt. If that is the case then try not to let it eat at you. Just move on and focus on future projects.
