Default pricing the sale for online all-rights use

I submitted a few photos for consideration to several magazines. One responded with
"How much for online all-rights use?" I responded with quoting a price for single online magazine publication and asked for further clarification of the question to purchase the online all rights use.

The editor responded,
"We generally don’t do “one time rights” for online use...

We’re always looking to build our “all rights” photo library as its hard for us to justify paying over and over again for an image that’s 110 pixels x 75 pixels...

So if you have a price on what it would cost for me to have full, unlimited (online only) rights to this image (and other’s like it)...lets hear it.

Unusual question. But I am trying to determine a price for such a request. I would still keep rights for print work out. Any help in determining such a request would be helpful. Thankyou

Its really not an unusual question. Usually the rate is based on the amount of traffic at the site, much like the magazine rates are based on the subscription rates. If you can determine their subscription base, or the monthly traffic, you can get a better idea of how to price it.

And the type of on-line magazine makes a big difference also. People magazines on-line magazine rate will be a lot different than a run of the mill on-line magazine only site.

I know it isn't that much help, but you haven't given us much to base it on either.

I would be worried about the all rights request. I think what they really want is royalty free.

To me, 'unlimited (online only) rights' is sort of an oxymoron.

It may be just a symantics issue, but if you give them 'all rights' that's what they have and you've lost control over how they use it.

I would offer an RF license with verbage granting them unlimited use in *.com online magazine. If they want to print it in their paper magazine, that's a different license.

Good point Darryl, the lawyers would pick up on the 'all rights' and beat that to death. If he words it right, he can grant all rights in all on-line media and be safe, much like photographers currently grant all rights, english language, north america only. But if mis-worded, or a comma in the wrong place, and 'all rights' could mean everything!

I had my lawyer draft my rights grants for all the basic scenarios since the wording isn't my territory, and those are the only ones I use. Almost all of my clients needs fit in the basic scenarios, so it works.
