Hey guys I hope this is the right forum...
In Ma the legal age of consent is 16... now i know in reference to the rape laws this is the case but what else does it pertain to. I'm having trouble finding info on this. For instance if i have a model who is 17, which I have been getting a lot of interest from younger girls just starting out, can they sign their own release? I usually get the parents to sign but a model told me she usually signs her own and i thought well the legal age is 16 maybe that means she can. How does this effect clients and submitting releases to mags and such...? Thanks for any help. Mike Photo

As far as i know the legal age in the US is 18 for any legal matters. Since a release form is a legal matter i would venture to guess it should be 18 as well. If in doubt, go with 18.
EDIT: in case you didn't understand my post, i merely said that i believe that the age when you are legally independent and can sign for yourself in legal matters is always 18. the age of consent (which ALWAYS carries extra clauses, such as max age differences or the definition of consent) has nothing to do with other legal matters, even if they are at the same age as other laws

Thanks for the reply... It depends on what you are consenting thats why im trying to find out more.
Every state has different ages for legal consent of sex and it also differs for men and women. Some states are as young as 14 and others 18. Ma happens to be 16 for women and 18 for men. Both MO and NJ are 16 for men and women. But my question is how does this effect other consent right specifically releases.

I don't believe the age of sexual consent and the age of being a minor in the eyes of the law have anything to do with one another. At 16, you may be old enough to legally consent to sex, but still not old enough to legally sign contracts on your own or be prosecuted as an adult for a crime you commit.

Unrelated.
Age of majority in MA is 18. See http://www.mass.gov/legis/laws/mgl/231-85p.htm I would assume MA has rules on the ability of a minor to void an agreement (and until when they can void it). You may want to check into that if you determine to enter into agreements with minors. --------- The above isn't legal advice. And don't blame me if MA law has been amended. |

A minor can sue for emancipation at nearly any age but AFAIK, the only age that would hold up in court over a legal document like a realease is 18.

Thanks guys thats what I was looking to find out. I always thought it was a different usage of consent so I will remain with my current releases for minors that have both guardian and model sign off on.
