It's still going on... the Heineken lawyers are doing their best to drag it out and obfuscate in the hope that the photographers won't pursue the claim - but that's not going to happen! As soon as I have more concrete news to report I'll post an update.

Wow, I never saw this. I hope they'll hurry up and realise that they have to deal with the fact that they stuffed up, it was their fault and not the web developers. Obviously it's been going for a while but good luck in whatever happens next, Richard.

A very interesting read. I missed this thread the first time round.

I had to laugh at this bit:

Have they taken leave of their senses, or is this the kind of nonsense that gets dreamt up in legal circles?

So, when someone damages their own reputation (Heineken, in this case), it's not actually their fault, but the fault of their victims for seeking recourse.

Interesting reading, hope that there was a favourable result for you (and other affected photographers) blackshadow!

I'm curious how stock photographers go about assigning value to images?

XYZ image is worth .99 on one agency and 9$ on the other. How does it work for these images?

Good question actually Karl. The way I see it (I don't contribute to any microstock sites though, but still):

If I'd choose to put a photo for sale on a microstock site, I'm not saying it is only worth .99, but I am saying you may use it for .99...

I had causes where I licensed photo XY for $100 on one day to someone and for $1000 the next day to another person. Does not mean it's worth either of the amounts imho, but kind of means to me that it's worth this or that price for a certain usage.

The real problem only arises when photographers are actually foolish (dare I say stupid) enough to believe their image is only worth .99 instead of (sometimes) 10,000 times that.

No updates for over fourteen months now. Maybe something to do with lawyers has happened that stopped Blackshadow from commenting any further on this subject.
