Default Charging 40D Batteries

Do batteries have to be flat before recharging, or can half charged batteries be topped up

I charge mine under either of those conditions. If I am shooting the entire weekend at a track then even if I'm at 50% charge I'll pop them in the charger as I don't know how taxing the next day will be and last thing I want is to get caught without any fully charged spares. Currently using 6 BP511A's for two 40D's and when the 3rd arrives that amount is certainly going to have to increase a lot more

Yeah, you can charge lithiums from whenever, unlike the NiCads.

No, this concept is a hold-over from the old NiCad batteries which had a memory.
