About 5 months ago I left my last employer over fraudulent buisness tactics and overall unprofessional behavior. On their part not mine. About 30 minutes ago a friend of mine calls and says that they saw a commercial from this ex-employer.
In this commercial is my 11 month old son prominantly displayed while they talk about how the employer cares about the community. I am beyond irate I never signed any release. This took place at a promotional event that the public was invited to come to for free. It's a really tight shot that I remember seeing the camera guy shooting in our general direction. Is there anything I can do to get this commercial edited? I live in Denver CO and the company is based here. Ordinarily I would have no issue with thsi but knowing what I know of the companies screw the consumer practices I am livid my son is associated with their name now. |

Contact the station airing the commercial and simply explain that there is no release for your son to appear.

Contact the station that aired it and ask to speak to either the Programming Director or the Station Manager.
Explain the situation and ask very politely for the name of either the agency or production company responsible for creating the spot. Contact them and tell them that there is no release and that you will be contacting an attorney. I can virtually guarentee they'll re-edit it that same day and redistribute a new version. If they don't, contact an attorney and have a cease and desist letter drafted sending copies to the agency/production company and the station(s) that ran it.

My first call would be to my attorney and let them handle it. You may be able to get it stopped AND get paid for it. If the employer did use it without permissions they OWE you something for that!
