rights for theatre shows - UK

posted this in 'business section' by mistake - probably better here.

I took photos of some amateur shows (specifically "We Will Rock You") with the permission of the Company staging them (my daughter was in the shows).

Their permissions 9rights?) allowed the making of videos (which they did) but said nothing about stills.

I sold some books and photos to Company members.

The Company then ceased and was taken over by the Musical Director under another name.

I now wish to enter some of these photos in competitions/sell them.

The current Musical Director says the original company gave me permission implicitly ( by allowing me to take the photos) before so still ok to use them now.

I just want to make sure :-

Who now hold these 'rights' - which I understand are rights to hold the production?

I obviously hold the copyright to the photos.

I don't want to publish these photos only to be hit by a law suit from the original show (which is still in the West End ).

It was a very high standard production and sold out a 1700 theatre for a week.

Hmmm... I think that entering competitions would be fine. Selling pictures to people who were in the show would be fine. Trying to sell pictures more widely would be likely to land you in trouble (do you think you would find much of a market for such pictures outside of the original cast, anyway?)

Here is my understanding, but I am not a lawyer.

Amateur companies don't get the rights to video record shows because very often the rights holders that amateur companies deal with do not have those rights. So, for example, Twentieth Century Fox owns the video rights to The Sound Of Music, not Weinberger's (or French, or whoever).

Re selling photos more widely: There is an active 'Queen' fan club & I was asked originally to give them access to the photos but I refused (I had them online for a while for cast members)

Update:

NODA reckoned I couldn't use the shots; however I emailed Phil McIntyre Productions direct & received the following reply:

Thank you for your email. As far as anyone here is concerned the photos are yours to do with what you wish.
