Depends on the crime :) In the situation the OP described, I don't know any local DA that would press charges if the OP didn't want to. Lack of consent is hard to prove when the victim doesn't want to press charges :-p

You are a better man than I am... I'd be in jail for murder. Press charges, its more humane than the alternative.

I'd be going over the lens with a fine tooth comb. I can't imagine such a scum bag treating it with the care such an expensive lens deserves.

I would of taken my 70-200 back, attached it to the 7D, then proceed to snap shots of the assclap being searched by the police. If a cop would ask what am I doing? I would reply, making sure it still works :p. That's just my New York state of mind :).

a) He's an idiot college student.

b) It's probably more work than it's worth to press charges as you have to go through the whole entire legal process not to mention hiring a lawyer and what not.

But it's worth it for a free consultation!

His exposure is minimal, if any, OP doesn't really need a lawyer as the victim of the theft of an ordinary object. OP may be called to testify if a trial is requested, but likely the perp will plead out. I see no downside to this.
