I was under the impression that the cases carry a lifetime warranty. What is their reason for their response, "may not be covered by the warranty"?

So it says on the Pelican website (I also send that quote to the online shop I bought it from).
I did not receive a response by the shop on my claim (that I believe this should be covered by the warranty). Hopefully this isn't going to cost me any money.

Contact Pelican directly. The shop does not back the warranty, the manufacturer does, and I am sure Pelican will replace it for you.

does anybody know the SMALLEST pelican that can hold a canon 7D WITH grip upright with a lens on it? In other words, what depth does it need to be for it to fit? I am looking for a pelican that is more briefcase-like, not suitcase-like.

Pelican has some top-loading model cases like this:

The 7D and 70-200 need about 12", which should fit vertically. Is that what you're looking for? Or did you want to lay it flat in a regular case? Either way, you'll need one internal dimension to be 12".
