Interesting. Who do you shoot for?

a publication that requires 30-day exclusivity usage as part of their contract:cool:

I usually submit 3-5

Ah that is what I thought. Around here the guys do 15ish total after "deadlining" 3-5.

Same here, I usually submit 10 more for online usage, but 3-5 are submitted for deadline. The rest are usually transmitted after the game.

Odd.

It is odd that a publication doesn't want to get scooped?

Exactly. I don't find it odd at all that they require a photo I submitted not be used in any commercial capacity for 30 days. I realize that posting a photo here isn't commercial use, but I like to play it safe and respect their usage.

Well I doubt anyone is rushing to "scoop" anyone over a team in the Sun Belt. I was more saying it was odd because I hadn't heard that before for local newspapers. Even the much larger papers typically only want you to wait until after publication before you post or self-publish images. I've also never had to sign a contract to freelance for a publication. Therefore, to me, it is odd.

I don't like working without some kind of contract. I don't want anything left to someone else's understanding, let's just get it in writing. It could have to do with the fact that it's the state's largest newspaper and it wants exclusive use for 30 days before anyone else can use it. I don't really think it's about scooping as much as it's about simply having primary usage rights. If you don't have a contract, how do you know what the usage rights are as far as the photographer is concerned or the publication for that matter. Do they have rights in perpetuity to use them anytime from here to eternity? These are all questions that get answered in a contract.

Fair enough. I shoot for the 9th largest paper in the country and they have a standard freelance agreement that you either agree with or you don't. I understand the comfort of having a contract, it's just not standard practice for news photojournalism unless you become contracted by the paper. Not knocking what you have set up as it clearly works for you. We move such a high volume of photos, extended exclusive rights aren't really a concern. If they want exclusive usage rights they negotiate it per assignment or per photo.

That's pretty much the way it is here, only they have the exclusive usage as part of the contract. You can take it or leave it, but they're the only game in town, so not much you can do. It's partly about building up their stock photo library as well. I wish I could negotiate on a per photo basis because I've seen other submitted photos, coaches on the sideline, players on the sideline, etc., used 2 or 3 times in the ensuing 30 days and I don't get paid for that usage, but it's a means to an end at this point and it's not like I'm getting rich off of it anyway, it's $5-600 on a good month, so it's nice to have, but I wouldn't starve if it dried up. In the end, I love shooting sports is what it boils down to;)

I hear that. It's nice making an extra $600+ a month and only have to give up a few hours of my Friday nights.
