...if you have evidence that the money isn't going to where it was intended you should either post it or withdraw you allegation.

I assume you noticed that the photographer who was being sued had links and updates to the website raising that money. So Gary would have had to fake that website or hack it. What you said was that Gary pulled a fast one and the money was not going to the photographer. I don't see how that is possible.
Maybe you should explain what you mean by "Fast one" and what is giving you that impression. Law suits take time and it is very possible we will never be updated.
