love this one - only just spotted him or her as we drove past - I snuck out of the car really really quietly and got a bit closer - hares are incredibly spooky and run at the slightest strange noise or sight.

As long as it's on YOUR Flickr, Facebook, website etc it's not an " orphaned work " from what I understand as this proves it's your's.

What's to stop a "third" party illegally copyimg and stripping identifying data and publishing an image. Then that image is free for all?

with google image search you can find similar images fairly easily. Surely the clause that states "diligant search" would incorporate that?

If you could show that within 5 clicks you can find your image on google you surey will be able to back charge for the use as they clearly didn't do the diligent checks before hand?

It will be interesting to see how this pans out and im sure the lawyers are rubbing their hands with glee.
