Joeseph - That looks similar to a lot of "photo contest" rules. Many of them are just copyrights grabs. The prize is usually of much less value than then rights would have been.

However, from the situation in the OP, this didn't sound like a contest scenario.

Not a whole lot, actually. Most of them use a corn starch power, dyed to color it. It could make you cough pretty bad, and people with pre-existing conditions may have trouble, but a healthy person isn't likely to suffer any long-term injury.

Yeah, it's likely to be much harder on equipment than it is on people.

It's essential that you get permission from the people in your photos to allow us to use them.

So I wonder if the photog had a release from the girl in the image.

It only matters if the publisher has a release. And the color run probably had a broadly emcompassing release as part of their race packet.
